These terms and conditions of rental form part of the contract for the transfer of use of motorbikes between Feel it - Canary Islands Motorcycles (lessor) and the customer (lessee), unless otherwise agreed in writing.

a) In the event of an accident or theft, you must contact the company within 24 hours of the incident. You must also report the theft to the LOCAL POLICE, NATIONAL POLICE OR CIVIL GUARD. The contact telephone number of the rental company is +34 608 41 45 81.
b) By signing this contract, the driver/s acknowledge having read and accepted the conditions detailed in this contract necessary for the driving of the vehicle.
c) Undertakes to respect at all times the traffic regulations in force and to be responsible for any penalties that may arise from the misuse or non-compliance with the regulations and for the duration of this contract.
d) The company is NOT liable for its own damage caused by bad or reckless driving, and driving under the influence of alcohol or drugs exempts the company from any liability.
e) Any damage that may be caused by the lessor shall be subject to an expert appraisal and subsequent estimate by the lessee. This means that the deposit cannot be returned until the value of the repair has been certified with a provisional estimate.
f) In the event of non-compliance with any of the conditions detailed above, https://www.feelitmotorcycles.com may terminate this agreement at any time by demanding the return of the vehicle and the holder of this agreement undertakes to return the vehicle to our base as soon as possible.
g) Authorises https://www. feelitmotorcycles.com to use this data for our marketing operations and to include it in our database for future communication actions.


SCOPE OF THE CONTRACT
a) These General Terms and Conditions apply to the vehicle reservation service (hereinafter referred to as the service) that feelitmotorcycles.com, with its registered office at Calle San Elias, 7. 38009 Santa Cruz de Tenerife, makes available to the user on its website https://www.feelitmotorcycles.com and in the rental contract. The use by the client of the service presupposes, in any case, adherence and conformity to the General Conditions of Contract in the version published by https://www. feelitmotorcycles.com at the same time of access to the service. Therefore, it is advisable that the customer read the General Conditions before using the service, which will be present at all times in Spanish language in the section in which the service is available. As proof of knowledge and acceptance of the same, the client will be obliged to sign this sheet attached to the contract of which he/she forms part if he/she agrees, once the characteristics of his/her reservation have been selected and the personal details necessary to formalise the same have been provided.
1. RENTAL REQUIREMENTS
The object of the contract with the lessor is exclusively the temporary transfer of the reserved motorbike, these motorbikes being vehicles registered as rental vehicles without driver. All prices are inclusive of compulsory insurance (liability insurance).

2. PERSONAL REQUIREMENTS OF THE DRIVER(S)
Motorbikes for A2 licence:
a) Over 18 years of age.
b) Have an A2 or A motorbike licence.
c) No photos, photocopies or reports and/or any other document other than the original ID card will be accepted.
d) If the customer does not meet the aforementioned conditions, the vehicle will not be delivered and the amount paid will not be refunded.
Motorbikes for A licence:
a) Over 18 years of age.
b) Have an A motorbike licence.
c) No photos, photocopies or reports and/or any other document other than the original ID card will be accepted.
d) If the customer does not meet the aforementioned conditions, the vehicle will not be delivered and the amount paid will not be refunded.

3. FINANCIAL REQUIREMENTS
Depending on the motorbike, the security deposit will have a value. This may range from €700 to €1,500. This deposit must be paid in advance by the lessee. Under no circumstances may the deposit be used to extend the rental period. Payment of these amounts must be made by credit card or in cash. This amount does not cover the total amount of the alleged damages, assuming that the damage to the vehicle exceeds the amount of the deposit must be paid by the client. In order to avoid paying for damages in excess of the value of the deposit, it is necessary to take out comprehensive insurance.

4. VEHICLE RESERVATION SERVICE
a) In order to use the service, users must follow the instructions required on the website or in the contract provided at the time of delivery of the vehicle.
b) Selection of booking data. Useful information about the driver(s), fares, equipment selected by the customer, place of delivery and pick-up will be required.
c) Reading and acceptance of these general conditions.
d) It will be sent to the user's e-mail account with the details of the booking made as well as a copy of these general terms and conditions, always supported by the corresponding booking confirmation document.
e) The credit card number is requested for the purpose of reservation or payment of the vehicle rental. We accept Visa and Master-Card international or issued by Spanish banks. American Express is not accepted.
f) Payment by credit card will only be made through the page designated by our entity, and the excess will not be charged until the moment of delivery of the vehicle.
g) Payment by card must be made by the driver(s). Otherwise the card holder must be at the place of delivery of the vehicle.
Prices: the prices for rental or sale are shown on our website, including 7% of IGIC.

5. BASIC INSURANCE COVERAGE
a) The motorbike is covered by comprehensive civil liability insurance for personal injury, property damage and damage to property.
b) At the time of delivery of the motorbike to the lessee, the lessee shall deposit a deposit in cash or by credit card, which shall be returned in full as soon as the motorbike is returned to the lessor undamaged. Any damage or damage suffered by the motorcycle will be deducted from the deposit.


6. COMPREHENSIVE COVER
The comprehensive cover covers damage to the vehicle as well as total or partial destruction, loss and/or theft of the vehicle, with an excess of XXX€ (depending on the motorbike). The comprehensive cover does not cover: loss of keys, breakage of keys, breakage of the drum unless the problem comes from a defect in the motorbike, punctures, nor salvage as a consequence of the same, roadside assistance due to lack of fuel or loss of keys, helmets whether lost or stolen, padlock whether lost or stolen, mobile phone holder whether lost or stolen. In the event of an accident, the customer is responsible for collecting the motorbike. In the event of using fuel that does not correspond to that which is in the motorbike, the repair will be the responsibility of the contracting party, loss and/or breakage of accessories and personal belongings. Accidents caused by the effects of alcohol and/or drugs will not be covered.
UNDER NO CIRCUMSTANCES DOES ALL RISK COVER MEDICAL ASSISTANCE FOR PERSONAL INJURY, CALL 112!!!!

7. DELIVERY OF VEHICLE
a) The motorbike shall be returned with a full tank, clean, in perfect condition and without externally recognisable defects. The lessee must return it at the end of the rental period in the same condition in which it was delivered, with a full tank, as well as at the agreed place, date and time, with complete documentation, keys, tools and accessories. In the event of loss of tools, keys and/or vehicle documentation, the lessee shall bear the full replacement costs. If the motorbike is returned in a considerably dirty state, the hirer shall pay the cleaning costs.
b) Fuel costs are not included in the price.
c) Fuel policy: full on delivery / full on return.
d) The landlord can terminate the rental agreement immediately if he becomes aware of a serious reason for which the rental agreement cannot be maintained. Serious grounds include, in particular, misrepresentation of personal and/or creditworthiness data as well as a serious breach of contractual obligations as per clause 12. In the event of immediate termination of the contract, the motorbike shall be returned immediately, also before the end of the regular rental period, without prejudice to the lessor's rights to compensation.


8. RETURN OF VEHICLES
The motorbike shall be returned at the agreed time on the agreed day. Each hour of delay in returning the vehicle will result in a penalty for each hour of delay in terms of damages caused to the company.
In case of home delivery or return, https://www. feelitmotorcycles.com warns that due to traffic difficulties it may sometimes arrive earlier or later than the agreed time. https://www. feelitmotorcycles.com will keep the customer informed at all times of the status of their delivery.


9. WHAT TO DO IN THE EVENT OF AN ACCIDENT OR BREAKDOWN
In the event of any claim, even in the event of breakdowns/damage or accidents not involving third parties, the Hirer is obliged to notify the Rental Firm immediately by telephone. The contact telephone number of the leasing company is +34 608 41 45 81. Towing and/or repair services can only be requested after prior agreement with the lessor and the travel costs for the collection of the motorbike are € 50. In every case of an accident, the police must be called immediately and evidence must be secured (fingerprints, witnesses, etc.), the details of the parties involved in the accident must be obtained and, in short, everything must be done that may contribute to clarifying the circumstances of the accident properly and completely. The Hirer undertakes not to make any admission of guilt and to refrain from acts (payments, agreements) that could jeopardise the insurance cover.


10. VEHICLES-FUEL-MAINTENANCE
Fuel is not included in the price. https://www.feelitmotorcycles.com will deliver the motorbike to the driver with a full tank of fuel. The customer must return the motorbike with a full tank of fuel. In case of lack of fuel, 25€ will be charged. In concept of gasoline and penalty for time and displacement that must be made to complete the tank, regardless of whether the tank is partially empty or completely empty. "No exceptions" All our motorbikes use 95 unleaded petrol. If there is any error in the refuelling and as a consequence the motorbike suffers any damage, the repair will be paid in full by the client. The maintenance and lubrication of the vehicle are included in our rates. Expenses incurred on the road and after approval by the rental office, will be reimbursed at the end of the rental period on presentation of the original receipt of payment. (Punctures and/or tyre changes resulting from misuse of the vehicle are not included). "Mechanical wear and tear due to normal use of the vehicle shall be borne by the lessor. In the event of damage to the vehicle, as well as its accessories and complements, and/or theft of the same, the Lessee will be charged for the following concepts and amounts:

d) Neumáticos: pinchazos. Sujeto a peritaje por parte de https://www.feelitmotorcycles.com
e) Cabina: tapicería, salpicadero, cinturones. Sujeto a peritaje por parte de https://www.feelitmotorcycles.com
f) Accesorios: pérdida, sustracción. Sujeto a peritaje por parte de https://www.feelitmotorcycles.com
g) In case of loss of keys, the Lessor shall pay for them. The cost of the motorbike key is 150€. The cost of the key to the padlock or key to the boot is €30 and the cost of the delivery of the keys or the motorbike locksmith is €50.
h) In case of loss of the padlock, you must pay for it. The cost is €30 and the cost of the journey to deliver the keys or open the motorbike is €50. To all the amounts mentioned above, the corresponding Value Added Tax or tax that replaces it will be added.


11. OBLIGATIONS AND LIABILITY OF THE LESSOR
The lessor shall hand over the motorbike in an undamaged condition and in a perfect state of cleanliness, functioning and road safety, as well as with the seals of the mechanical components intact, and the lessee shall also receive the vehicle's documentation and tools. The lessor shall only accept damage that is written in writing in the rental contract upon delivery and signed by both the lessor and the lessee as proof of conformity. Damage to tyres must, in principle, be paid for by the Hirer.


12. OBLIGATIONS OF THE LESSEE
The Hirer shall use the motorbike with due care, in particular in compliance with the technical regulations and the instructions in the manual, and shall ensure traffic safety. The oil and water level, tyre pressure and the correct tension of the drive chain must be checked regularly by the Hirer during the rental period. The hirer must comply with the legal regulations, in particular the highway code, and is liable for all administrative costs, fines and penalties resulting from his use of the vehicle.


IN PARTICULAR IT IS PROHIBITED TO...
(a) transfer the motorbike to drivers other than the authorised drivers named in the rental contract, with the exception of a second driver included in the contract with the consent of the lessor.
(b) transfer the motorbike to a driver authorised in accordance with the contract, if the latter's driving licence has been withdrawn or if he/she is not in possession of a valid driving licence or is not fit to drive.
(c) use the motorbike if his driving licence has been withdrawn or if he is not in possession of a valid driving licence.
(d) using the motorbike in an unfit state.
(e) participate in motor sport events of any kind, including trials.
(f) use the motorbike off paved roads or for beach riding.
(g) tamper with the speedometer/tachometer, and shall immediately report any defect in the speedometer/tachometer to the lessor.
(h) to pledge, sell or dispose of the motorbike or its parts, equipment, accessories and documentation in any other way which may prejudice the lessor's rights as owner or any other rights the lessor may have in the motorbike.
i) parking the rented motorbike without the appropriate anti-theft or anti-theft insurance in place and/or activated.
j) moving the motorbike outside the territory of Tenerife without permission.


13.LESSEE'S LIABILITY FOR DAMAGES
From the time of delivery of the motorbike until its return, the lessee shall be liable to the lessor, even for slight negligence, for the loss or disappearance/destruction of the rented motorbike (including the loss or confiscation/seizure/sealing of the motorbike and/or parts thereof), as well as for all damage caused to the motorcycle during the rental period and which exceeds normal wear and tear (such as, for example, accident damage or damage not caused by external impact, damage caused by improper use and deterioration). In the event of damage to the rental motorbike, the Hirer is liable for the costs of repair, rescue or salvage and removal or repatriation, expert's fees, technical or economic deterioration, loss of rental during the time of repair or, in the event of total loss, during the time required for replacement. In the event of loss of hire, the basic daily rate shall be paid for each day that has elapsed. In the event of a lesser loss, the Hirer shall be responsible for proving this. The Hirer shall also be liable for any accessories borrowed, such as helmets including visor, jackets, gloves, loss of documents or vehicle keys, etc. Furthermore, the Hirer is expressly advised that he is also liable for damage/damage in the following cases, if the Hirer himself or the person designated by him to drive the vehicle:
(a) fails to fulfil the obligations, paragraph 12
(b) leaves the scene of the accident without authorisation in the event of an accident/injury at fault
(c) causes damage intentionally or through gross negligence.
d) exceeds the rental period contrary to the contract.


14. CONDITIONS OF TERMINATION AND CANCELLATION OF RESERVATION
In the event that the customer wishes to extend the contract, he/she must inform https://www.feelitmotorcycles.com. This extension will be subject to the availability of vehicles and availability of the company, subject to payment and renewal of the contract. In order to extend and/or renew the contract, the customer must visit one of our offices. Extensions and/or renewals are not made by any other method than in person at our office.
In the event that the customer wishes to cancel the contract, this must be communicated to https://www.feelitmotorcycles.com. This cancellation will correspond to the refund of the money previously paid by the customer. The credit will be made directly to your credit card. https://www.feelitmotorcycles.com will not be responsible for any bank charges that may exist in the process.
Feel it - Canary Islands Motorcycles does not charge processing or cancellation fees for bookings cancelled more than 30 days prior to arrival date.
The following percentages of the total rental price will be charged in case of cancellation:
Up to 30 days before departure: Free of charge
Between 29 and 15 days before departure: 30%
14 to 8 days before departure: 50%
Between 7 and day before departure: 80%
In case of no-show: 100%

15. DISCLAIMER OF LIABILITY
Feel it - Canary Islands Motorcycles is not responsible for any damages that may arise from, but not limited to:
a) Delays or blockages in the Internet network caused by deficiencies or overloads as well as any other electronic system.
b) The impossibility of providing the service or allowing access for any reason.
(c) of any event beyond its control that prevents the booking from being made. Anomalous operation is understood to mean the incorrect issuance of reservations or errors of any kind.
d) If the vehicle breaks down due to a defect, https://www.feelitmotorcycles.com will replace the vehicle as soon as possible and within the established opening hours. If it is not possible to replace the vehicle, https://www.feelitmotorcycles.com will refund the amount corresponding to the days not used at the selected rate.

16. APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions shall be governed by Spanish law, which shall apply to any matters not provided for in these General Terms and Conditions regarding interpretation, validity and execution. The parties expressly submit to the courts and tribunals of the place of fulfilment of the obligation to settle any dispute that may arise in the interpretation and/or execution of these General Terms and Conditions of Contract.
